Acceptable Use Policy

What you can and cannot do with APEX, the responsibilities that come with an account, and how we enforce it.

Effective July 6, 2026. This Acceptable Use Policy (the "AUP") governs use of the APEX services (the "Services") provided by ApexAVCloud LLC ("APEX", "we", "us", or "our"), a Delaware limited liability company with offices at 5009 N Ashland Ave #3E, Chicago, IL 60640. Capitalized terms not defined here have the meaning given in the Terms of Service (the "Agreement"). This AUP is incorporated into the Agreement; a violation of this AUP is a violation of the Agreement.

1. Who this applies to

This AUP applies to Customer and to every User, Contractor, Integrator, Tenant, and vendor that accesses the Services through Customer's account. Customer is responsible for the acts and omissions of its Users as if they were Customer's own.

2. Prohibited activities

You may not use the Services to, and may not permit any User to:

2.1. Break the law. Engage in or promote any activity that violates applicable Laws, including export control and economic sanctions Laws, or that infringes or misappropriates the Intellectual Property Rights or privacy rights of any third party.

2.2. Upload harmful content. Transmit any material that contains viruses, worms, ransomware, time bombs, or other harmful code, or that is unlawful, defamatory, harassing, or otherwise objectionable.

2.3. Attack the platform. Probe, scan, or test the vulnerability of the Services or any APEX system or network; breach or circumvent any security, authentication, rate-limiting, or tenant-isolation measure; or attempt to access another tenant's data, accounts, or environments. Authorized security testing requires APEX's prior written consent (email [email protected]).

2.4. Overload or interfere. Interfere with or disrupt the integrity or performance of the Services, including through denial-of-service activity, sending unsolicited bulk messages ("spam") through the Services, or imposing an unreasonable or disproportionately large load on the infrastructure.

2.5. Misuse access. Reverse engineer, decompile, or disassemble the Services or APEX Technology except to the extent that restriction is prohibited by Law; resell, sublicense, or make the Services available to any third party except as expressly permitted in the Agreement; or use the Services to build a competing product.

2.6. Scrape or harvest. Use any robot, spider, scraper, or other automated means to access the Services other than through APEX-provided APIs in accordance with the Documentation.

2.7. Falsify identity. Impersonate any person or entity, misrepresent your affiliation, or forge headers or identifiers.

3. Customer responsibilities

3.1. Account security. Keep credentials confidential, use the access controls APEX provides (including role-based access and, where available, two-factor authentication), and notify APEX promptly of any suspected unauthorized access at [email protected].

3.2. Lawful data and notices. The Services collect telemetry, configuration, and event data from AV devices, conferencing endpoints, and related infrastructure, which may include information about employees, contractors, visitors, or meeting participants. Customer is solely responsible for providing any notices to, and obtaining any consents from, those persons required under applicable Laws (including workplace-monitoring, video, audio, privacy, and employee-notification Laws), as further described in the Agreement and the Data Processing Addendum.

3.3. Appropriate content. Customer is responsible for the legality, accuracy, and appropriateness of all Customer Data it submits to the Services.

4. Enforcement and suspension

APEX may investigate suspected violations of this AUP. Where practical, APEX will give notice and an opportunity to cure. APEX may suspend or limit access to the Services without prior notice if it reasonably determines that continued use poses a security risk, may disrupt the Services or other customers, may subject APEX to liability, or violates applicable Law. APEX will restore access promptly once the issue giving rise to the suspension is resolved, consistent with the suspension terms of the Agreement.

5. Reporting abuse

Report suspected violations of this AUP, security issues, or abusive activity to [email protected]. We review every report.

6. Changes

APEX may update this AUP from time to time in accordance with the modification terms of the Agreement. Material changes take effect on the terms described there.
